What are Florida's porta potty rules?

Florida rule 62-6.0101 sets restroom counts for construction sites (1 per 10 workers, weekly service) and special events (Table PR I, daily service), requires 1 hand wash facility per 10 restrooms, and requires every unit to show the service company's name and phone. Service companies need an annual permit from the county where they keep a yard.

What does OSHA require on construction sites?

OSHA 29 CFR 1926.51(c) Table D-1 requires 1 toilet for 20 or fewer workers, 1 toilet seat and 1 urinal per 40 workers for 20 or more, and 1 seat and 1 urinal per 50 workers for 200 or more. OSHA 1926.51(f) requires washing facilities where workers handle paint, coatings, herbicides or other contaminants.

Official text: OSHA 1926.51. In Florida, the state table is stricter for most crews, so follow it.

What does OSHA require on farms?

OSHA 29 CFR 1928.110 requires farms with 11 or more hand-labor workers in the field to provide 1 toilet and 1 handwashing facility per 20 workers, within a quarter-mile walk of each worker. That covers potato and cabbage crews around Hastings, fern crews around Pierson and nursery crews around Apopka.

What does the ADA require for portable toilets?

The 2010 ADA Standards, section 213.2, require that where portable toilets are clustered, at least 5 percent, and no fewer than 1, in each cluster be accessible. The accessible unit needs a turning space of a 60-inch-diameter circle or a T-shaped space, and an accessible route to the door.

Legal minimum vs. our recommendation

The legal minimum is the count in the rules above. Our recommendation adds 1 unit when alcohol is served, 1 unit for parties longer than 5 hours, and a hand wash station at any event with food, even when sanitizer would meet the minimum. Your permit office or venue can require more than either.

This page explains rules in plain words. It is not legal advice. Confirm requirements with your permit office, inspector or venue before your event or job starts.

Questions renters ask

Do I need a permit to put a porta potty on my property in Florida?

A porta potty on private property for your own use usually needs no separate permit. Public events and units on streets or sidewalks may need city or county approval, and event organizers must give the state a signed service contract one working day ahead.

How often must a porta potty be serviced in Florida?

Florida requires portable restrooms to be serviced at least once a week, and at least once a day at special events.

Does a porta potty need a sign?

Florida requires every portable restroom to show the service company's name and phone number. Hand wash stations need a sign saying the water is not for drinking.
